Whats the difference between contested and uncontested divorce and whats the duration ?

me and my spouse are planning to seperate and divorce. I would like to know how long does contested divorce and uncontested divorce take place ? also, is there a time frame for legal seperation ? if so how long is it ? and what is the time frame for uncontested divorce ? how long does contested divorce take ?
To add to this, I also do not own any property as im just renting an apartment will I have to pay anything for spousal support ? I also do not have any kids with my spouse.Please advise.

From what I understand an uncontested divorce is where both party’s want the divorce. A contested divorce is where one of the party’s don’t want the divorce. Also I think an uncontested divorce takes a lot less time. They said my uncontested divorce will take about a month and we probably wont even have to stand before a judge. I live in Georgia.

How long is the process of an uncontested divorce? Can i move while in the process?

How long is the process of an uncontested divorce and what is the process, do i have to appear in court or can it all be done through paperwork? Can I move out of state during the process and make a trip back if needed? My state of residency is Kansas.

An uncontested divorce should take about 3 months after the separation requirements are met.

Where do I go to get uncontested divorce papers?

I am wondering where I go in my city to get divorce papers without having to go through a lawyer for a uncontested divorce.

your local city ditrict clerk’s office would most likley have them. in my city the clerks office is located at the local traffic court building. i belive its the same clerk you would pay for a trffic ticket aswell. you can also go to a lawyers office without getting involved with the layer. just call the lawyer;s paralegal assistant or receptionist and some will just let you have a copy. i would call the local clerk’s office with the city distric municiple court system and ask them. i would think they would have them but im positive that if they dont they can tell you who dose.

How easy is it to do an uncontested divorce on your own?

I recently separated from my husband in July. I am now looking into trying to file for uncontested divorce on my own. We do not own a house or anything like that together, but we do have a 3yr old daughter. How hard will this be? Any experience is greatly appreciated.

I went to file for my divorce and was told by the clerk that the judge will reject any divorce that does not have an attorney involved if there are minor children.

I went with a client of mine today to file hers, and she was told that since there were minor children, she had to have a trial, but they did not require an attorney.

These were two different counties, but you should call your clerk to see what the requirements are. The clerk cannot give you legal advice, but they should be able to direct you to where you can get the papers you need to begin to file, if you will be able to do it on your own.

I have linked you to a site with books and information that I read before writing up the papers for my divorce, although I ultimately wasn’t able to use them.

How do you get a divorce uncontested or anulled?

A friend of mine is interested in getting an annulment or a uncontested divorce. Her husband is in jail. Does this make it harder to do this?

Annulment is separate from a divorce, and requires different things to qualify, and depends on the law of your state.

In an uncontested divorce, both sides sign the papers, and usually neither side is served with papers.

But this is likely to be easiest to do as contested divorce. Judges are very unlikely to sign paperwork to get someone out of prison to come to a divorce trial. So the easies, quickest thing is to file for divorce, have husband served with papers, set it for trial, and when husband doesn’t show up, just ask the judge to sign the papers your friend brought.
