Could I file for an uncontested divorce?

Posted by admin on March 31st, 2010 and filed under Uncontested Divorce | 7 Comments »

Im not sure what reason allow you to file for an uncontested divorce are or not, but here’s my story. My husband and I got married two months ago. We argue about stupid things, this last time he moved out, changed his number and that was a week ago. Since, he’s been verbally and emotionally abusive and is signed up on all of these singles dating websites. Are these grounds for an uncontested divorce or would I be better off trying to get it anulled?

An uncontested divorce means you both agree to the divorce, and all aspects of it. Its completely different from an annulment (which is a way to dissolve a marriage making it so that it never happened). Annulments are difficult and require your marriage to fall under some pretty specific issues such as duress, fraud, polygamy, etc.
If you and your husband agree to the divorce then you can do it yourself, without a lawyer.

Is it possible to file an uncontested divorce from the US if married in Alberta Canada to a Canadian resident?

Posted by admin on March 29th, 2010 and filed under Uncontested Divorce | 2 Comments »

I was married, but now want to get a divorce. My spouse is also fine with the uncontested divorce. Problem is, I am a U.S. resident living in Georgia and she is a Canadian resident living in Alberta. Can I file for divorce from here through the Canadian system or do I need to file in my current state of residency? Any advice would be great.

File your divorce where you live I think. Ask your lawyer what is best to do!

What is a notice of setting for an uncontested divorce?

Posted by admin on March 21st, 2010 and filed under Uncontested Divorce | 3 Comments »

I am getting a divorce and it is uncontested so I am doing everything myself. I called today and set up a date for the hearing. I was told I needed to fax over a notice of setting. Is this something I make myself? Or is it a form I fill out?? Not real sure what I need to do but am hoping to take care of it asap since my lazy ex won’t help with anything.

Notice of Setting (Hearing)

That is what I found.. If you havent tried, I would try (see below in the source box.)

Hope it helps!
