can I get spousal support in my divorce?

Posted by admin on April 12th, 2010 and filed under Divorce Support | No Comments »

I am filing for a divorce for domestic abuse, adultery and abandonment, can i get spousal support if he earned more money than me the 7 years we were married?

Yes, you can. It just depends on the state you are in. Each state has its own rules about alimony, how much is awarded, for how long, etc.
If you earned more money than him its quite likely you’d be awarded it, but again, it just all depends on your state’s laws.
Now, whether or not he’s going to pay it is another story. If he’s that swell of a guy, he’ll most likely avoid paying it. However if you have court ordered alimony and he refuses to pay it, he can get hard… (again depending on the state) he can have his drivers license revoked, or worse, put in jail!

Here’s a site that will help you determine the laws of your state:

I just seperated from my wife and want to start paying child support before divorce. How much?

Posted by admin on April 10th, 2010 and filed under Divorce Support | 12 Comments »

I’m not sure how long it will take to finalize the divorce. I love my child and want the best for her. I just don’t know how much I should give until the courts decide.

What is the average percentage of your income to go towards child support? I live in FL.

Ah Ha! Been there and doing that. Go to the DOR (Department of Revenue) link on myflorida.com. You’ll find a table that the state uses to compute child support. The percentages go up per child obviously but 1 child = 33%. The top is 55% of your salary for childsupport only but then they can add in insurance, day care costs plus other things like medical bills. Good luck. I applaud you for caring enough. I’ve been paying for 10 years and never missed a payment.

In California, question on separation, divorce, child support & alimoney?

Posted by admin on April 8th, 2010 and filed under Divorce Support | 4 Comments »

I am a stay-at-home mom and am divorcing my alcoholic husband. At present, the alimony & child support I will receive won’t be enough to continue caring for my son full-time. I’ll have to put him in daycare 9 hours a day to make ends meet (I DON’T want to do that!).
Here is the question…My husband is being considered for a new job where he will make $50,000 more per year! If I wait to file for divorce until he starts this new job, will I receive more in child support and alimony? I wonder mainly because we’ve been separated for 4 months and I don’t know if the courts will look at his income at the time of separation or at the time the divorce is filed.
I know some nasty person is going to call me money grubbing, but this is ALL about avoiding putting my young son in daycare all day long when he’s used to being at home with me. I’ll be working full-time as soon as he’s in regular school.
Thanks!

Been there, done that. His current income status will be looked at when the divorce is filed.

How to support Sister going through divorce?

Posted by admin on April 6th, 2010 and filed under Divorce Support | 5 Comments »

I am somewhat estranged from my sister who lives across the country, but found out through family that she is having a really hard time and her husband is pushing for a divorce. What is the best way for a family to support a sister going through a divorce? If you’ve gone through a divorce, what support did you find helpful?

there’s really nothing you can do but tell her you love her and if she ever needs anything you will be there for her.

Is a wife who cheats on her husband & files for divorce entitled to spousal support?

Posted by admin on April 4th, 2010 and filed under Divorce Support | 14 Comments »

Hi i have never been married & dont plan on anytime soon..
But i was just wondering that if a wife cheats on her husband & they no children & she files for divorce to be with another guy is she entitled to spousal support?

I think legally if you are married for the right amount of time they are ….unless you had a prenup agreement stating infidelity entitles them to nothing. I do think that she shouldn’t get it!!!!!
