Does a child’s guardian have to pay support in a divorce in the state of PA?

Posted by admin on March 31st, 2010 and filed under Divorce Support | 6 Comments »

My husband and I have raised our granddaughter since birth (she is now 9 years old). We obtained legal guardianship (for schooling purposes) two months ago. Now just last week my husband announced he filed for divorce. Does he have to pay support for her since he has been doing so all along. We have been married for 29 years and I have been a housewife at his request all this time.

I think you need a lawyer for that question !!
But it seems that he wont have to pay !!
You need to go after the biological parents !!

Could I file for an uncontested divorce?

Posted by admin on March 31st, 2010 and filed under Uncontested Divorce | 7 Comments »

Im not sure what reason allow you to file for an uncontested divorce are or not, but here’s my story. My husband and I got married two months ago. We argue about stupid things, this last time he moved out, changed his number and that was a week ago. Since, he’s been verbally and emotionally abusive and is signed up on all of these singles dating websites. Are these grounds for an uncontested divorce or would I be better off trying to get it anulled?

An uncontested divorce means you both agree to the divorce, and all aspects of it. Its completely different from an annulment (which is a way to dissolve a marriage making it so that it never happened). Annulments are difficult and require your marriage to fall under some pretty specific issues such as duress, fraud, polygamy, etc.
If you and your husband agree to the divorce then you can do it yourself, without a lawyer.

Divorce Laws For Women In New York City?

Posted by admin on March 31st, 2010 and filed under Divorce Laws | 2 Comments »

I am dealing with a person who is trying to get a divorce in New York. But she is having a VERY HARD TIME doing it! What exactly are the laws regarding divorce for women? Thanks!

She needs to find a lawyer who understands that marriage and divorce laws are state by state and not city by city. It would also help if the lawyer knew that the law applied to both women and men.

Please also feel free to warn me about bad experiences you may have encountered with legal representation in the area.

Is it possible to stop paying child support after a divorce with a praternity test?

Posted by admin on March 29th, 2010 and filed under Divorce Support | 8 Comments »

I am recently divorced (x 6mo) and have been paying child support and now it has come out that the mother never really was sure who the father was. We had him before the marriage so i am wondering if i got a praternity test and he wasnt mine could i go to court and stop paying child support or am i screwed since the divorce is final.

First, hire a lawyer. No one here can tell you anything, and specifically since we don’t know where you live, we can’t even know what the law is in your state if we could give you any advice.

However, the answer also depends on the jurisdiction you live in. In most states, once you admit to paternity, even if it turns out you were duped; it doesn’t matter. You’re on the hook for life unless you’ve been contesting paternity all along.

There are trends, however, to "punish" the mother for lying to the putative father when it comes out that the paternity shows another man to be the true, biological father.

So in a divorce situation, if the wife knew about the other man being the father, its possible to skew the property distribution or alimony towards the husband who has been stuck with paternity.

Check with a lawyer though. Everything hinges on facts and the law in your jurisdiction.

Is it possible to file an uncontested divorce from the US if married in Alberta Canada to a Canadian resident?

Posted by admin on March 29th, 2010 and filed under Uncontested Divorce | 2 Comments »

I was married, but now want to get a divorce. My spouse is also fine with the uncontested divorce. Problem is, I am a U.S. resident living in Georgia and she is a Canadian resident living in Alberta. Can I file for divorce from here through the Canadian system or do I need to file in my current state of residency? Any advice would be great.

File your divorce where you live I think. Ask your lawyer what is best to do!
